To officially participate in this production field, businesses must fully meet the strict requirements stipulated in specialized legal documents, from conditions on facilities, technology, capital sources to standards on measurement and product quality. - Conditions for the production of gold jewelry and fine arts
Gold jewelry and fine arts are gold products with a content of 8 Karat (equivalent to 33.33%) or more, processed and crafted to serve the needs of jewelry and fine arts decoration. According to the provisions of Article 4 of Decree No. 24/2012/ND-CP of the Government on the management of gold trading activities, the production of gold jewelry and fine arts is a conditional business activity and must be granted a Certificate of eligibility to produce gold jewelry and fine arts by the State Bank. This is also a prerequisite for businesses to be able to operate in the field of gold jewelry and fine arts production.
According to Article 5 of Decree 24/2012/ND-CP, enterprises producing gold jewelry and fine arts are granted a Certificate of eligibility to produce gold jewelry and fine arts by the State Bank when they meet the following conditions:
– Being an enterprise established in accordance with the provisions of law, having registered to produce gold jewelry and fine arts in the Certificate of Business Registration.
– Having a location, facilities and necessary equipment to serve the production of gold jewelry and fine arts.
- Responsibilities of enterprises engaged in the production of gold jewelry and fine arts
When producing gold jewelry and fine arts, production establishments have the responsibilities stated in Article 6 of Decree 24/2012/ND-CP (amended and supplemented by Decree 232/2025/ND-CP), specifically as follows:
– Implement the stamping of codes and gold content on products, announce applicable standards, product weight according to legal regulations and be responsible before the law for the announced applicable standards and the declared product weight produced by the enterprise.
– Be responsible before the law for the announced applicable standards and the weight of products that the enterprise hires for processing.
– Comply with legal regulations on accounting regime, preparation and use of invoices and documents.
– Have a plan to ensure safety in production and business activities, environmental protection and fire and explosion prevention.
– Ensure the maintenance of the conditions specified in Clause 1, Article 5 of Decree 24/2012/ND-CP. When selling raw gold purchased from enterprises, commercial banks specified in Article 11a of Decree 24/2012/ND-CP (amended and supplemented in 2025) must create and use electronic invoices in accordance with the provisions of law; fully and accurately store data on raw gold sales transactions; connect to provide information to the State Bank in accordance with the provisions of the Governor of the State Bank.
– Comply with the provisions of this Decree and other relevant legal provisions.
- Application for Certificate of eligibility to produce gold jewelry and fine arts
The application for Certificate of eligibility to produce gold jewelry and fine arts is made into 01 set in Vietnamese, including the following documents as prescribed in Article 3, Article 12 of Circular No. 34/2025/TT-NHNN of the State Bank of Vietnam:
(i) Application for Certificate of eligibility to produce gold jewelry and fine arts according to the form in Appendix No. 01 issued with Circular 34/2025/TT-NHNN. This document must be signed by the legal representative or authorized representative. In case of signing by authorization, the application must have a power of attorney made in accordance with the provisions of law.
(ii) Document or documents proving the ownership or legal right to use the production location;
(iii) Declaration of facilities and equipment necessary for the production of gold jewelry and fine arts.Note:
– Each set of documents must include a list of documents.
– For the document components that are copies, a copy must be submitted from the original book or a certified copy or a copy with the original for comparison. In case the applicant submits a copy with the original for comparison, the person who compares must sign to confirm the copy and be responsible for the accuracy of the copy compared to the original.
– In case of submitting documents online, the documents in the electronic dossier are electronic copies scanned from the original, the original (PDF file format).
- Procedures for requesting a Certificate of eligibility to produce gold jewelry and fine arts
Step 1: Submitting documents
Enterprises wishing to produce gold jewelry and fine arts submit their documents to the State Bank branch in the region where the enterprise has its head office. The dossier is submitted in one of the following forms:
– Submit online via the National Public Service Portal, National Single Window Portal (if any). When submitting the dossier online via the National Public Service Portal, National Single Window Portal, the electronic dossier is used with a digital signature in accordance with the provisions of law on performing administrative procedures in the electronic environment.
– Submit directly at the Single Window Department of the State Bank of Vietnam or the Single Window Department of the State Bank Regional Branch (where the enterprise or credit institution has its head office);
– Send via postal service.
Step 2: Review the dossier
Within 03 working days from the date of receiving the dossier requesting the issuance of a Certificate of eligibility to produce gold jewelry and fine arts, the State Bank of Vietnam or the State Bank Regional Branch shall notify the applicant of the completeness and validity of the dossier.
Within 20 working days from the date of receiving a complete and valid dossier and the results of the actual inspection of the facilities and equipment serving the production of gold jewelry and fine arts of the enterprise, the Director of the State Bank Regional Branch shall issue or refuse to issue (clearly stating the reason) a Certificate of eligibility to produce gold jewelry and fine arts.
