From 2021, how is the retirement age of female workers under normal working conditions regulated?
Information from 2021, the retirement age of female workers in normal working conditions is stipulated below:
Pursuant to Clause 2, Article 169 of the 2019 Labor Code, from 2021, the retirement age of female workers in normal working conditions is stipulated as follows:
Retirement age
- The retirement age of workers in normal working conditions is adjusted according to the roadmap until reaching the age of 62 for male workers in 2028 and the age of 60 for female workers in 2035.
From 2021, the retirement age of workers in normal working conditions is 60 years and 3 months for male workers and 55 years and 4 months for female workers; then, each year it increases by 3 months for male workers and 4 months for female workers.
Accordingly, from 2021, the retirement age of female workers in normal working conditions is set at 55 years and 4 months for female workers; then, every year and 4 months for female workers.
What are the rights and obligations of workers?
According to Article 5 of the 2019 Labor Code, the rights and obligations of workers are stipulated as follows:
(1) Workers have the following rights:
– To work; to freely choose a job, workplace, occupation, to learn a trade, to improve their professional qualifications; not to be discriminated against, forced to work, or sexually harassed at work
– To receive wages appropriate to their qualifications and professional skills based on an agreement with the employer; to be protected by labor, to work in conditions that ensure occupational safety and hygiene; leave according to the regime, annual leave with pay and collective benefits
– Establish, join and operate in organizations representing employees, professional organizations and other organizations according to the provisions of law; request and participate in dialogue, implement democratic regulations, collective bargaining with employers and be consulted at the workplace to protect their legitimate and legal rights and interests; participate in management according to the employer’s regulations
– Refuse to work if there is a clear risk of direct threat to life and health during the performance of work
– Unilaterally terminate the labor contract
– Strike
– Other rights according to the provisions of law.
(2) Employees have the following obligations:
– Implement the labor contract, collective labor agreement and other legal agreements
– Comply with labor discipline and labor regulations; comply with the management, operation and supervision of the employer
– Implement the provisions of the law on labor, employment, vocational education, social insurance, health insurance, unemployment insurance and occupational safety and hygiene.
What are the State’s policies on labor?
According to Article 4 of the 2019 Labor Code, the State’s policies on labor are as follows:
(1) Ensure the legitimate and legal rights and interests of employees and workers without labor relations; encourage agreements that ensure more favorable conditions for employees than those prescribed by the law on labor.
(2) Ensure the legitimate rights and interests of employers, manage labor in accordance with the law, democratically, fairly, civilly and enhance social responsibility.
(3) Create favorable conditions for job creation, self-employment, vocational training and vocational training to get a job; production and business activities that attract a lot of labor; apply some provisions of this Code to workers without labor relations.
(4) Have policies to develop and distribute human resources; improve labor productivity; train, foster and improve qualifications and vocational skills for workers; support the maintenance and conversion of occupations and jobs for workers; give incentives to qualified workers high-level expertise and technology to meet the requirements of the industrial revolution, the cause of industrialization and modernization of the country.
(5) Have policies to develop the labor market, diversify forms of connecting labor supply and demand.
(6) Promote dialogue and collective bargaining between employees and employers, build progressive, harmonious and stable labor relations.
(7) Ensure gender equality; regulate labor regimes and social policies to protect female workers, workers with disabilities, elderly workers and underage workers.
