2. Who is required to participate in unemployment insurance?

Pursuant to Article 43 of the Employment Law 2013 stipulates the subjects required to participate in unemployment insurance, specifically as follows:

  1. Employees must participate in unemployment insurance when working under a labor contract or a working contract as follows:
  2. a) An employment contract or an indefinite term employment contract;
  3. b) Labor contract or working contract with definite term;
  4. c) Seasonal or job-specific labor contracts with a term of from full 3 months to less than 12 months.

In case the employee enters into and is performing many labor contracts specified in this Clause, the employee and the employer of the first signed labor contract are responsible for participating in unemployment insurance. .

  1. Employees specified in Clause 1 of this Article who are enjoying pensions or doing domestic work are not required to participate in unemployment insurance.
  2. Employers participating in unemployment insurance include state agencies, public non-business units, people’s armed forces units; political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations; foreign agencies, organizations and international organizations operating in the Vietnamese territory; enterprises, cooperatives, households, business households, cooperative groups, other organizations and individuals that hire or use employees under working contracts or labor contracts specified in Clause 1 of this Article. .

Accordingly, employees participating in labor contracts or working contracts are compulsory subjects to participate in unemployment insurance, except for employees who are receiving pensions or doing domestic work.

3. How much is the current unemployment insurance premium?

Pursuant to Article 57 of the Employment Law 2013 stipulates the payment rates, sources of formation and use of the Unemployment Insurance Fund, specifically as follows:

  1. Unemployment insurance premiums and responsibilities are prescribed as follows:
  2. a) Employees pay 1% of monthly salary;
  3. b) The employer pays 1% of the monthly salary fund of the employees participating in unemployment insurance;
  4. c) The State shall support up to 1% of the monthly salary fund on which unemployment insurance premiums are based for employees participating in unemployment insurance and guaranteed by the central budget.
  5. Sources of formation of the Unemployment Insurance Fund include:
  6. a) Payments and support as prescribed in Clause 1 of this Article;
  7. b) Profits from investment activities from the fund;
  8. c) Other lawful sources of income.
  9. The unemployment insurance fund is used as follows:
  10. a) Payment of unemployment benefits;
  11. b) Support in training, fostering and improving vocational skills to maintain jobs for employees;
  12. c) Vocational training support;
  13. d) Provide counseling and job placement support;
  14. dd) To pay health insurance premiums for unemployment benefits recipients;
  15. e) Unemployment insurance management expenses shall comply with the provisions of the Law on Social Insurance;
  16. g) Invest to preserve and grow the Fund.

Accordingly, the employee pays unemployment insurance equal to 1% of the monthly salary and the employer pays 1% of the monthly salary fund of the employees participating in unemployment insurance.

4. What is the principle of unemployment insurance?

Pursuant to Article 41 of the 2013 Employment Law stipulating the principles of unemployment insurance, specifically as follows:

  2. The unemployment insurance premium is calculated on the basis of the employee’s salary.
  3. Unemployment insurance benefits are calculated on the basis of unemployment insurance premiums and payment period.
  4. The implementation of unemployment insurance must be simple, easy, convenient, timely and fully ensuring the interests of the participants.
  5. The unemployment insurance fund is managed centrally, uniformly, openly, transparently, ensures safety and is protected by the State.
